Governor Gavin Newsom Sues Trump Administration Over Alleged National Guard Takeover

 

California Governor Gavin Newsom has filed a high-profile lawsuit against the Trump administration, alleging an illegal federal overreach in what he calls a “hostile and unauthorized” takeover of the California National Guard.

The legal battle comes amid growing tensions between state and federal authorities after former President Donald Trump, who is seeking reelection in 2026, publicly praised a plan to “restructure and federalize” the National Guard in blue states he claims are failing in “law and order.”


Governor Newsom’s lawsuit, filed early Monday in the 9th Circuit Court of Appeals, accuses the Trump-aligned Defense Department of bypassing state authority and violating the Constitution by attempting to wrest control of California’s National Guard without state consent.

“This is not just an attack on California. This is an attack on federalism, on the independence of our states, and on every American who values constitutional balance,” Newsom said at a press conference this morning. “Trump and his allies cannot just treat the National Guard like a private army to push their political agenda.”


According to documents obtained by the Sacramento Bee, the Trump-era executive directive revived by conservative lawmakers and supported by key figures in the MAGA base seeks to consolidate command of National Guard units under federal control “in times of persistent civil unrest,” a phrase critics argue is dangerously vague.


Legal experts say the lawsuit could have sweeping implications for state rights and military jurisdiction. “This is unprecedented. A state challenging a former president and his political network over military authority could redefine the guardrails of executive power,” said Professor Linda Chang, a constitutional law scholar at UC Berkeley.


Trump responded via Truth Social, calling Newsom “a disgrace to America” and “a fake leader who should thank me for even caring about California.”


This isn’t the first time Newsom and Trump have clashed, but this legal action could ignite a new chapter in their political rivalry one that now pits state sovereignty against the long shadow of Trump’s influence over America’s security institutions.


The Department of Defense has not commented on the lawsuit as of press time.


The case is expected to move quickly through the courts, with national implications hanging in the balance.
