Elon Musk is going head to head with the state of New York in a high-stakes legal battle over what he says is a direct attack on free speech. The billionaire owner of X (formerly Twitter) has filed a lawsuit challenging the state’s newly passed Stop Hiding Hate Act officially known as Bill S895B.
The law, aimed at holding social media platforms accountable for addressing hate speech, requires companies to report and moderate hateful conduct on their platforms. But Musk isn’t having it.
In the lawsuit, Musk argues that the law is unconstitutional and violates the First Amendment, which protects free speech even if that speech is offensive or unpopular. “This isn’t about hate,” a source close to the case said. “It’s about control and the government trying to dictate what people can say online.”
Supporters of the bill say it’s a necessary move to combat rising online harassment, extremism, and hate fueled violence. But Musk and his legal team see it differently, framing the law as a dangerous precedent that could lead to government overreach and censorship of political or controversial opinions.
The case is already stirring national debate. Free speech advocates are watching closely, while civil rights groups argue that online hate has real world consequences and needs to be addressed.
