U.S. Supreme Court to Decide If Social Media Algorithms Have Free Speech Rights


The Supreme Court has agreed to hear a landmark case examining whether social media platforms’ recommendation algorithms are entitled to First Amendment protections. The case, Smith v. Meta, challenges whether algorithms that curate content are a form of “speech” or simply neutral tools.


The plaintiff argues that Meta’s (formerly Facebook) algorithm suppresses conservative viewpoints, violating free speech rights. Meta contends its algorithms are proprietary technology, exempt from constitutional scrutiny.

Legal experts say the ruling could reshape digital content regulation and impact censorship debates across social media.
